Another Google Case is Going to Court

As Google is reporting higher and higher earnings quarter, there are more and more people who want to a piece of the pie. These people are even looking to go to court for achieving this.

While most cases are sent back after the initial review, some make it to the second stage, and this case is just one of those. American Blind & Wallpaper Factory vs Google was set for jury selection in November.

According to the suits: American Blind & Wallpaper Factory, the top US reseller of window blinds, charged in its lawsuit that Google abuses trademarks by allowing rivals of a company to buy ads that appear when consumers search the web for information on that business.

American Blind adds that while they do not mind Google placing ads on SERPS for “blinds” but their claim is that when people search for “American Blinds” there people are clearly looking for them and by advertising other businesses, Google is infringing their copyrights for the name.

Google’s response to this suit was nothing but confidence for their position: Google litigation counsel Catherine Lacavera said Friday that the company was confident ABWF “will be unable to prove” their claims at trial.
