Sean,

Whether or not the American people vote or do not vote for a certain measure does not determine whether or not it violates or does not violate the constitution. You would love for an informed public that can make an appropriate decision - but - unfortunately, the driving disinformation by our two party system can drive votes in the wrong direction.

It's also important to note that we are NOT a pure democracy. We have an judicial and executive branch of government which have just as much power as the representation. I'll add as well that we have a congress and senate. Senate does not reflect democracy, it represents states.

It's a complex government system that has worked well for quite some time. But that doesn't make it perfect. We need to always maintain vigilance against distortion of the original rights and freedoms.

Mark:

You and Douglas make excellent points. However, this is still a democracy and both right and left wings only get away with what the American people allow them to get away with.

The term "Use it or Lose it" comes to mind. If people aren't exercising their freedoms they don't value them enough to fight for them. If people spend more time deciding on their American Idol vote than their president and Congress, then we'll continue to lose more and more freedoms.
Vote Sanjiyah in 2008!

I totally agree - with one exception. You state 'this administration' but both the democrats and the republicans have unanimously backed the reduction of our personal freedoms and right to privacy through these decisions. Please check the voting record and write your congressman and senators.

This country was founded on the Bill of Rights. At one time, that didn't extend to companies; however, now our country is putting business rights before the rights of an individual.
