		<description>Thanks Joe. One thing that I&#039;ve learned recently is that fair use isn&#039;t law, it&#039;s a &lt;em&gt;defense&lt;/em&gt;.  So you have to be sued, etc first, then apply it.  In the meantime, well you can imagine.

I&#039;m all for better attribution standards and I think the AP has the right to say you need to attribute like this, but pay them?  Umm, yeah, no.</description>

		<description>Tris this is a thoughtful post, and I really like the idea of having a group of bloggers (and maybe AP too - but frankly I don&#039;t think they are needed for this) meet to discuss attribution standards.   Jeff Jarvis &amp; Matt Ingram both have suggested good attribution frameworks I&#039;d be happy to follow (though I&#039;m going to keep being sloppy until there&#039;s more progress in this area).   

Everybody from AP to Arrington thinks they have a good sense of &quot;clear violations / clearly fair use&quot; but that is absurd because it&#039;s subjective, subject to changing legal interpretations, and subject to the ambiguities of online experience.
