One thing that I've learned recently is that fair use isn't law, it's a <em>defense</em>. So you have to be sued, etc first, then apply it. In the meantime, well you can imagine. I'm all for better attribution standards and I think the AP has the right to say you need to attribute like this, but pay them? Umm, yeah, no. Thanks Joe. Jeff Jarvis & Matt Ingram both have suggested good attribution frameworks I'd be happy to follow (though I'm going to keep being sloppy until there's more progress in this area). Everybody from AP to Arrington thinks they have a good sense of "clear violations / clearly fair use" but that is absurd because it's subjective, subject to changing legal interpretations, and subject to the ambiguities of online experience.
