NY Judge has decided to rule against the appeal of Amazon and Overstock about the new ruling which requires online retailers to collect sales tax.
In the current setup, online retailers are exempted from getting sales tax from people are transacting business where they do not have physical presence in the place.
Amazon and Overstock are hoping that the judge would not require the seller to pay taxes but Judge Bransten contends that out-of-state resellers should also shoulder their fair share of the tax collection burden whenever New Yorkers earn profit from other New Yorkers.
